Resale flat checklist: title, NOC and dues before you pay token money

A resale purchase brings its own set of title, dues and transfer checks — on top of, not instead of, what RERA already covers.

1. Chain of title

Get your lawyer to review the ownership chain properly, not just skim the latest sale deed. That means going back a meaningful stretch, commonly 12–13 years or more depending on the property, through prior agreements and the mutation entries in the land records.

If there's a break in that chain, or the title is still sitting with the builder or a deceased owner, stop and get a lawyer's opinion before going any further. This isn't a box to tick and clear later; it's the check that protects everything after it.

2. Society NOC and dues

Two things to request from the RWA upfront: a no-dues certificate covering maintenance charges, and confirmation that there's no pending litigation involving either the flat or the society itself.

Then ask what NOCs or clearances they require for a membership transfer. Get that moving early — every society is a little different, and clearances can take a few weeks to come through.

3. Loan and encumbrance status

Pull an encumbrance certificate through the Haryana land records portal, jamabandi.nic.in. This tells you whether the flat is mortgaged, attached, or tied to a pending loan against the seller.

If there's an active loan, the payoff and lien release need to happen before or at registration. A verbal promise that it'll get "sorted after" isn't a plan; it's a risk you'd be taking on for someone else's debt.

Before you transfer funds

Check the latest property tax receipt, confirm there are no outstanding dues with the municipal corporation, and make sure the sale agreement spells out who's responsible for clearing anything that turns up before registration.

None of this replaces a lawyer's review on a high-value purchase. It just makes that review faster and cheaper, because you'll be walking in with the groundwork already done.
